This Privacy Policy is incorporated into and subject to the terms of the Golden 1 Center Terms of Use. This Privacy Policy applies only to information submitted and collected online through the Services, and does not apply to information that we may collect offline or other than through the Services. In addition, this Privacy Policy is applicable regardless of the device used to access the Services (e.g., personal computer, mobile device, consumer electronics device, or any other technology or software known today or developed in the future) and to all users of Services (“Users”). However, certain terms of this Privacy Policy apply only to those Users whose use of portions of the Services require registration (“Registered Users”), for example, portions of the Mobile App.

This Privacy Policy does not apply to information about you collected by third party services, applications, or websites or advertisements associated with, linked to or otherwise accessible from the Services, including, but not limited to, any third party ticketing service (currently Ticketmaster), food service providers and merchandise providers. The information collected or received by such third parties, including (if applicable) any credit card information, is subject to their own privacy policies or practices and under no circumstances is Golden 1 Center responsible or liable for the third party’s compliance therewith.

We collect (and retain) personally identifiable information from you through the Services by expressly requesting it from you, (i) at the time you become a Registered User, (ii) when you enter information in connection with applying for a job with us, (iii) when you request information from us via email or sign up for emails, notifications or newsletters, (iv) when you access the Services through certain social media and (v) if you choose to participate in certain activities like sweepstakes, contests and surveys accessed through the Services. In addition, when you use the Services in any capacity (whether as a Registered User or not). Golden 1 Center may also automatically collect personally identifiable information from you.

We will also collect personally identifiable information that you elect to provide us or make publicly known in emails, chat rooms and other communications features provided by the Services (collectively, “Personal Communications”). Personal Communications are provided by you at your sole discretion. Information transmitted via our Services is stored on our servers, and deleted emails may remain archived or exist in system backups.

Certain personal information may be removed from our database as described below under the caption “Retention and Modifications.”

• Our Use of Information. We use the information we collect via the Services only for legitimate business purposes as follows:

  • to establish you as a Registered User;
  • to provide the services offered by Golden 1 Center through the Services;
  • to correspond with you regarding Golden 1 Center, employment decisions, results of contests or sweepstakes or to inform you of developments in our company or with our services that we believe may be of interest to you;
  • to personalize your use of Golden 1 Center, including to allow us to personalize the content and advertising that you see on the Services;
  • to contact you via phone, text or social media platforms in follow up to inquiries made by you, to send you alerts or to otherwise contact you with information that we believe may be of interest to you;
  • to conduct internal marketing and demographic studies and other research and development for the improvement of the Services in order to provide you and other Users with a better experience and drive User growth and engagement;
  • to monitor usage and other activity relating to our Services;
  • for internal operations, including troubleshooting, diagnosing problems with servers;
  • for identification and security purposes; and
  • to comply with applicable laws; to enforce our Terms of Use; and to protect the rights, property, or safety of ourselves, our Users, and others.

Mobile App. Without limiting the generality of the foregoing as applicable to the Mobile App, we collect the information from the Mobile App primarily to facilitate the functionality of our Mobile App and deliver valuable, entertaining content and advertising to you at or relating to our venue. We may collect your device's location in order to show you offers or features available near you at our venue, to deliver more relevant information and ads, and to understand how users interact with our venue. We may combine data we collect through our Mobile App with other information we hold about you so that we can personalize or improve the relevance and quality of the services we provide you.

Geo-location Services. If you tell us where you are (e.g., automatically by allowing your mobile device to send us your location), we may store and use that information to provide you with location-based services.

Sweepstakes and Contents. If you participate in sweepstakes or contests through the Services sponsored by us, your personal information may be used by us to contact you for winner notification, prize delivery confirmation or other promotional purposes. Your entry may also result in your being added to our marketing lists as well as those of third parties (sponsors or otherwise) associated with the sweepstakes or contest. If you win a sweepstakes or contest, your acceptance of a prize may require you (unless prohibited by law) to allow us to post publicly some of your personal information on our Services or elsewhere, such as on a winner's page. In some instances, where a third-party advertiser or sponsor may operate or host a sweepstakes or contest through the Services, we may obtain certain information you provided in connection therewith from the advertiser or sponsor.

Loyalty Program and Awards. When you become a Registered User, you are automatically enrolled in our Loyalty Program. Through this Loyalty Program you can earn points for certain activities or actions you undertake through the Services, which can be used to obtain certain awards. We will track your activities and actions in connection with the Loyalty Program, and use such information not only to provide awards but to better understand you and our Users and to improve our Services. The use of targeted awards is intended to encourage certain activities and actions.

• Our Sharing of Information. Your trust is important to us, which is why we don't share information we receive about you with others unless we have:

  • received your permission;
  • given you notice, such as by telling you about it in this Privacy Policy; or
  • removed your name or any other personally identifying information from it;

  or where it is necessary to carry out your instructions or in order to provide the features and functionality of the Services to you.

  • when we believe it is appropriate to investigate, prevent, or take action regarding illegal or suspected illegal activities (such as for potential fraud or infringement);

We require our affiliates and third parties providing services on our behalf, and our Users, to limit their use and disclosure of your information to uses and disclosures that are consistent with this Privacy Policy, however, we cannot guarantee their compliance. We may, however, also share, in aggregate, statistical form, non-personal information regarding traffic patterns, and Website usage with our partners or affiliates.

  In addition, non-personal information, including aggregated demographic and other information, may be shared with our current and potential sponsors and advertisers.

• Your Choices in Sharing Information. You may choose to share information with other Users through forums and chat rooms offered through the Services. We cannot and do not guarantee that any information you share in this fashion will be kept confidential or private.

We retain your personally identifiable information as needed to provide you the features and services offered through the Services. We reserve the right to retain information from our Registered Users even if their account is not active or for all Users even when they have stopped using the Services, if retention is reasonably necessary to comply with our legal obligations, meet regulatory requirements, resolve disputes between Users, prevent fraud and abuse, or enforce this Privacy Policy and our Terms of Use and for as long as is necessary to provide reporting and trend analysis relating to the Services. We may also retain personal information if requested by law enforcement.

We strive to maintain the accuracy of any personally identifiable information that may be collected from you, and will use our commercially reasonable efforts to respond promptly to update our database when you tell us the information in our database is not accurate. It is your responsibility to ensure that such information is accurate, complete and up-to-date. You have a right to access, modify, correct, or delete your personal information in your Account Profile created through the Mobile App. Note, however, that when you make use of the communication features of the Mobile App, such as a chat room or forum to share information with other Users, you generally cannot modify or remove such communications. Users who wish to delete or make any changes to any personally identifiable information provided to us, may do so by contacting us at info@golden1center.com. Information will be updated as soon a possible. Note that any removed information may persist in backup copies for a reasonable period of time but will not be generally available to Users. We may reject requests that are unreasonably repetitive, require disproportionate technical effort (for example, fundamentally changing an existing practice), risk the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup tapes).

You may sign up for our email notifications or newsletters on our Website. In addition, when you register on the Mobile App, you will automatically receive special offer emails and notifications.

You may opt out of receiving emails from us by following the opt-out link provided in any email received from us. You may opt-out of receiving other notifications from us by logging into your Account Profile on the Mobile App and changing your settings relating to such notifications.

In compliance with the Children’s Online Privacy Protection Act, 15 U.S.C. §§ 6501-06 and 16 C.F.R. §§ 312.1-312.12, our Service does not permit children under 13 years of age to become Registered Users, and Golden 1 Center does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register. By using our site, you represent that you are not under 13 years of age.

Golden 1 Center may reference or include links to third party websites. Golden 1 Center is not responsible for the third party websites or for the privacy policies or information practices of third parties or their websites. You should review the privacy policies posted on such sites. Moreover, Golden 1 Center does not have access to or control of the cookies that may be placed by such third parties.

Because security is important to both you and us, we will always make reasonable efforts to ensure the security of our systems. Golden 1 Center employs physical, electronic and administrative safeguards to protect the information we receive from you from unauthorized disclosure. This includes our requirement for user names and passwords to access certain portions of the Services and our use of industry-standard SSL encryption to protect certain data transmissions. Registered Users should not share their user names or passwords with anyone. In addition, if you suspect unauthorized access to your information, it is your responsibility to contact Golden 1 Center immediately at info@golden1center.com. Golden 1 Center personnel will never ask you to divulge your password in written or electronic communications. If at all, we will only ask you for your password when you contact us by phone and only in cases where you request customer service to correct a service problem that requires your password. Please be aware that Internet data transmission is not always secure and we cannot warrant that information you transmit utilizing this Site is secure.

We may, in the future, sell or otherwise transfer some or all of its assets to a third party. Your personally identifiable information and/or technical information we obtain from you via this Site may be disclosed to any potential or actual third party purchasers of such assets and/or may be among those assets transferred.

When a User who is located outside the United States uses our Services, becomes a Registered User of our Services or elects to make certain information available to us or other Users, it is the User who is responsible for ensuring whether such actions and the sharing of information with us conforms to the User’s local data protection laws. Golden 1 Center is not responsible under such local data protection laws for information obtained through Services

California Civil Code Section 1798.83, known as the “Shine The Light” law, permits our Users who are California residents to request and obtain from us a list of what personal information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year and the names and addresses of those third parties. Requests may be made only once a year and are free of charge. Under Section 1798.83, we currently do not share any personal information with third parties for their direct marketing purposes.

This Privacy Policy is effective as of July 1, 2016. We reserve the right, at any time, to modify, alter, or update this policy, and any such modifications, alterations, or updates will be effective upon posting. In the event we modify this Privacy Policy, your continued use of this Site will signify your acceptance of the modified Privacy Policy.
