The owner and operator of Golden 1 Center, Sacramento Downtown Arena LLC (“Golden 1 Center,” we,” “us” or “our”), realizes that privacy is an important issue for those using our www.golden1center.com site (including subdomains and mobile versions, the “Website”), mobile applications (“Mobile App”) or other cellular or web-enabled technologies (with the Website and Mobile App, collectively, the “Services”), and we take your privacy seriously. Please read the following to learn more about how we collect, use and safeguard the information you may provide to us via the Services.

If you do not agree to the terms of this Privacy Policy, please do not provide us with any information and do not use the Services. By using any of our Services, whether by visiting the Website, downloading or using the Mobile App, and/or voluntarily providing your personally identifiable information to us, you consent to the collection and use of your information as set forth in this Privacy Policy.

This Privacy Policy may be revised from time to time, and all such revisions shall be effective upon posting. Please revisit this page often to remain fully informed of our policies. If you object to any changes, you should refrain from using our Services. Continuing to use Golden 1 Center after we publish or communicate a notice about any changes to this Privacy Policy means that you are consenting to the changes.

APPLICABILITY OF THIS PRIVACY POLICY

This Privacy Policy is incorporated into and subject to the terms of the Golden 1 Center Terms of Use. This Privacy Policy applies only to information submitted and collected online through the Services, and does not apply to information that we may collect offline or other than through the Services. In addition, this Privacy Policy is applicable regardless of the device used to access the Services (e.g., personal computer, mobile device, consumer electronics device, or any other technology or software known today or developed in the future) and to all users of Services (“Users”). However, certain terms of this Privacy Policy apply only to those Users whose use of portions of the Services require registration (“Registered Users”), for example, portions of the Mobile App.

This Privacy Policy does not apply to information about you collected by third party services, applications, or websites or advertisements associated with, linked to or otherwise accessible from the Services, including, but not limited to, any third party ticketing service (currently Ticketmaster), food service providers and merchandise providers. The information collected or received by such third parties, including (if applicable) any credit card information, is subject to their own privacy policies or practices and under no circumstances is Golden 1 Center responsible or liable for the third party’s compliance therewith.

HOW DO WE COLLECT INFORMATION FROM YOU?

We collect (and retain) personally identifiable information from you through the Services by expressly requesting it from you, (i) at the time you become a Registered User, (ii) when you enter information in connection with applying for a job with us, (iii) when you request information from us via email or sign up for emails, notifications or newsletters, (iv) when you access the Services through certain social media and (v) if you choose to participate in certain activities like sweepstakes, contests and surveys accessed through the Services. In addition, when you use the Services in any capacity (whether as a Registered User or not). Golden 1 Center may also automatically collect personally identifiable information from you.

We will also collect personally identifiable information that you elect to provide us or make publicly known in emails, chat rooms and other communications features provided by the Services (collectively, “Personal Communications”). Personal Communications are provided by you at your sole discretion. Information transmitted via our Services is stored on our servers, and deleted emails may remain archived or exist in system backups.

Certain personal information may be removed from our database as described below under the caption “Retention and Modifications.”

WHAT INFORMATION DO WE COLLECT FROM YOU?

Via the Services, we collect from you: (i) certain personally identifiable information and (ii) technical and other information.

  • Personally Identifiable Information.

    General Website Visitors – When you browse the non-password protected portions of our Services, you do so anonymously; no personally identifiable information is collected.

    Downloading and Using the Mobile App - The Mobile App may automatically collect certain information which may be considered personally identifiable, such as your mobile device’s unique device ID, the IP address of your mobile device and your device's proprietary advertising identifier, as well as information relating to how you use the Mobile App, such as the content you view, ads you click, and purchases you make.

    Geo-Location Services - When you consent to our use of geo-location services, or otherwise depending on the settings on your mobile device, we or third party service providers may collect the precise location information provided by your device, including data provided by your GPS, WiFi, or otherwise obtained when the Mobile App or your device interacts with a beacon or other technology at our venue. If you want to deactivate this feature, you can deactivate GPS on your mobile device. Please refer to your device manufacturer for instructions on how to do this.

    Job Seekers - If you apply for a job through the Website, you will be required to provide us with certain personal information (including your first and last name, email address, user name and password). In addition, the online application will require you to provide certain other information, including education, employment history, title and job description. You may also provide additional personal information by way of a written summary or attach a resume and a portfolio. You are encouraged to provide the email addresses and phone numbers of those who can verify your employment history and provide references. Although providing certain information is optional, including such information will make your job application more useful.

    Participating in Sweepstakes and Contests - We may operate contests, sweepstakes or other promotions through our Services, which may require registration, including through our social media channels in order to enter. To the extent you elect to participate in any sweepstakes or contests sponsored by us through the Services, you will be required to provide us with certain personal information (including your name, address, gender, date of birth and email). You may also be asked to provide certain other information, which may be optional, including demographic information. You may also be required to provide information by way of answering written questions. However, sometimes sweepstakes or contents found through the Services are hosted or operated by a third-party advertiser or sponsor. In those cases where we are not the sponsor, operator or host of a sweepstakes or contest, we may have no control over the information collected and, accordingly, we encourage you to review the official rules of the sweepstakes or contest as well as the advertiser's or sponsor's privacy policy applicable to the sweepstakes or contest before participating.

    Surveys - We may occasionally feature surveys on our Services, which may collect certain personal information from you. For example, we may collect your name and email address, as well as other information, such as interests, hobbies, lifestyle choices, groups with whom you are affiliated (schools, companies, etc.) or that are specifically related to your experience at one of our events. By completing the survey, you consent to our collection of any personal information and other data you provide, and use of that information and data to administer, respond to, analyze or otherwise complete the survey process or as otherwise described in this Privacy Policy.

    Proximity beacons - We may collect data from physical “proximity beacons” located in or near our venues and (through partnerships with local businesses or entities) in areas or places visited by guests who have consented to our collection of data from beacons. Proximity beacons emit radio signals and detect when a device enters a specific area. As such, we may collect data about your location and other contextual data when you are near a beacon. If your device preferences allow us or our Mobile App access to location services, we may collect information about the location of your device in our venues, including data from each of our or our partners' beacons with which you interact, and we may send you relevant, targeted offers based on this data. We and any third parties enabling these features may store this data and combine it with other information about you. You may disable the communication of these beacons or control or limit the information we collect using these beacons with your mobile device by disabling Bluetooth or changing your device preferences relating to location services, or through your choices regarding Bluetooth, WiFi, and other network interfaces you may use to interact with our Services.

    Social Media - If you access the Services through a social media platform, you may allow us to have access to certain information in your profile associated with that platform. This may include your name, e-mail address, photo, gender, birthday, location, an ID associated with the applicable social networking account, user files like photos and videos, your list of friends, people you follow and/or who follow you, or your posts or “likes.” For example, if you access the Services through Facebook, we may also collect the following information about you from Facebook: (i) Facebook ID/User Name; (ii) first and last name; (iii) anything that you have made public in your Facebook profile; (iv) gender; (v) locale; (vi) age range; (vii) your location; (viii) your Facebook “likes”; and (ix) your comments. If you permit, we also may collect your birthday and email. We may combine information that we collect from or about you with information about you that we obtain from such social media platforms. Social media platforms typically allow its users to control what information can be shared, and you should review the applicable platform’s terms of use and privacy policy to understand how and what information gets shared and your rights and options with respect thereto.

    Contacting Us – Certain of our Services permit you to contact us via email. Whenever you send an email via our Services, you will be providing us with your name, email address and any information you choose to include in the text of your message. For example, you may choose to provide your mailing address, phone or mobile number or other information necessary or helpful for us to address your query or other concern.

    If you send us a text message, we may collect your mobile phone number, and the content of the message. When you send a text message, the incoming phone number, the wireless telecommunications service provider associated with the number and the date and time of the message will be logged by us.

  • Technical and Other Information. The Services use commonly-used automated information gathering tools. While you are using our Services (regardless of the device accessing the same), we automatically log your IP address (a number assigned to your computer or device when you use the Internet), general data (including your domain name and the name of the web page from which you entered the Website, the search engine and internet web browser you used to access the Website and the website you visit after the Website) and your activity while using the Services.

    When you download and use the Mobile App, we will automatically gather information such as the type of mobile device you use, your mobile device’s unique device ID, the IP address of your mobile device, the operating system for your mobile device, your carrier use ID, the type of mobile Internet browsers you use, and information about the way you use the Mobile App.

    Additionally, in order to personalize and enhance your Website and Mobile App experience, we may also collect information through “cookies.” Cookies are small strings of text that are sent by our Website to your browser or by the Mobile App and then stored on your computer’s hard drive or mobile device. We use cookies to help diagnose problems with our servers, administer our Services and troubleshoot technical concerns. We also use cookies to gather broad demographic information and to help identify you (by certain personally identifiable information) when you use the Services so that we may improve your user experience, and to determine whether you visited our Website from a particular Internet link or advertisement. We may also use small bits of code called “one-pixel gifs,” “clear gifs,” or “web beacons” embedded in web pages to gather certain web site information, as well as log files (entries on which are generated every time a User visits a particular page or clicks an image on our Website ) that passively record website activity. . These technologies enable Golden 1 Center to track a particular User’s visits to our Services, assess overall Website and Mobile App activity, track interest in particular web pages or features of our Services (a.k.a. "click-through data"), identify the type of browser you may be using are using and provide you more relevant advertisements. Certain additional technology used by Golden 1 Center allow us to associate the aforementioned information that we gather about usage of our Services with particular Registered Users. By visiting our Services, you consent to the placement of cookies and beacons in your browser and HTML-based emails in accordance with this Privacy Policy. Most web browsers automatically accept cookies, but it is possible to change your browser setup so that it warns you each time a cookie is being sent, blocks third party cookies or blocks or rejects all cookies. However, rejecting cookies may prevent you from taking advantage of certain portions of Golden 1 Center.

  • Tracking and Advertising. We do not engage in the collection of personally identifiable information about your online activities over time and across third party websites or online services. Accordingly, we do not currently process or comply with any web browser’s “do not track” signal or other mechanisms that provide consumers with the ability to exercise choice regarding the collection of personally identifiable information about your online activities over time and across third party websites. However, we allow some advertisers and other third party companies to collect certain non-personally identifiable information when you visit our Website or use the Mobile App which, through “tracking technologies,” can be combined with non-personally identifiable information during your visits to other websites or when you use other mobile applications in order to provide advertisements about goods and services likely to be of greater interest to you. These companies typically use a cookie or a third party web beacon to collect this information.

    In this regard, we may use network advertisers and ad exchanges to serve advertisements across the Internet. These networks and exchanges may also collect identifiers designed to enable advertising on your mobile device. These services may collect information and data about your activities online, both on our Services and on third-party websites, mobile applications or services that participate in the ad network, such as websites or applications that feature advertisements delivered by the ad network. This process helps us track the effectiveness of our marketing efforts. You may or may not be offered a choice as to whether or not to have your information collected for that purpose. These third-party tracking technologies may be set to, among other things: (a) help deliver advertisements to you that are tailored to your individual interests, either by us, our affiliates, or third parties (sometimes referred to as “behavioral advertising”); (b) prevent you from seeing the same advertisements too many times; and (c) understand the effectiveness of the advertisements that have been delivered to you.     We also use third party analytics service providers, such as Google Analytics or Adobe Omniture, to provide us and/or third parties with information about the viewing of these ads on our Services and third party websites or applications, and to better understand our Users’ use of our Services. We and third-party vendors use first-party cookies (such as the Google Analytics cookie) and third-party cookies (such as a DoubleClick cookie) together to report how your ad impressions, other uses of ad services, and interactions with these ad impressions and ad services are related to visits to our Services.

HOW IS YOUR INFORMATION USED?

Our Use of Information. We use the information we collect via the Services only for legitimate business purposes as follows:

  • to establish you as a Registered User;
  • to provide the services offered by Golden 1 Center through the Services;
  • to correspond with you regarding Golden 1 Center, employment decisions, results of contests or sweepstakes or to inform you of developments in our company or with our services that we believe may be of interest to you;
  • to personalize your use of Golden 1 Center, including to allow us to personalize the content and advertising that you see on the Services;
  • to contact you via phone, text or social media platforms in follow up to inquiries made by you, to send you alerts or to otherwise contact you with information that we believe may be of interest to you;
  • to conduct internal marketing and demographic studies and other research and development for the improvement of the Services in order to provide you and other Users with a better experience and drive User growth and engagement;
  • to monitor usage and other activity relating to our Services;
  • for internal operations, including troubleshooting, diagnosing problems with servers;
  • for identification and security purposes; and
  • to comply with applicable laws; to enforce our Terms of Use; and to protect the rights, property, or safety of ourselves, our Users, and others.

Mobile App. Without limiting the generality of the foregoing as applicable to the Mobile App, we collect the information from the Mobile App primarily to facilitate the functionality of our Mobile App and deliver valuable, entertaining content and advertising to you at or relating to our venue. We may collect your device's location in order to show you offers or features available near you at our venue, to deliver more relevant information and ads, and to understand how users interact with our venue. We may combine data we collect through our Mobile App with other information we hold about you so that we can personalize or improve the relevance and quality of the services we provide you.

Geo-location Services. If you tell us where you are (e.g., automatically by allowing your mobile device to send us your location), we may store and use that information to provide you with location-based services.

Sweepstakes and Contents. If you participate in sweepstakes or contests through the Services sponsored by us, your personal information may be used by us to contact you for winner notification, prize delivery confirmation or other promotional purposes. Your entry may also result in your being added to our marketing lists as well as those of third parties (sponsors or otherwise) associated with the sweepstakes or contest. If you win a sweepstakes or contest, your acceptance of a prize may require you (unless prohibited by law) to allow us to post publicly some of your personal information on our Services or elsewhere, such as on a winner's page. In some instances, where a third-party advertiser or sponsor may operate or host a sweepstakes or contest through the Services, we may obtain certain information you provided in connection therewith from the advertiser or sponsor.

Loyalty Program and Awards. When you become a Registered User, you are automatically enrolled in our Loyalty Program. Through this Loyalty Program you can earn points for certain activities or actions you undertake through the Services, which can be used to obtain certain awards. We will track your activities and actions in connection with the Loyalty Program, and use such information not only to provide awards but to better understand you and our Users and to improve our Services. The use of targeted awards is intended to encourage certain activities and actions.

We may, however, also share, in aggregate, statistical form, non-personal information regarding traffic patterns, and Website usage with our partners or affiliates.Your Choices in Sharing Information. You may choose to share information with other Users through forums and chat rooms offered through the Services. We cannot and do not guarantee that any information you share in this fashion will be kept confidential or private.

RETENTION AND MODIFICATIONS

We retain your personally identifiable information as needed to provide you the features and services offered through the Services. We reserve the right to retain information from our Registered Users even if their account is not active or for all Users even when they have stopped using the Services, if retention is reasonably necessary to comply with our legal obligations, meet regulatory requirements, resolve disputes between Users, prevent fraud and abuse, or enforce this Privacy Policy and our Terms of Use and for as long as is necessary to provide reporting and trend analysis relating to the Services. We may also retain personal information if requested by law enforcement.

We strive to maintain the accuracy of any personally identifiable information that may be collected from you, and will use our commercially reasonable efforts to respond promptly to update our database when you tell us the information in our database is not accurate. It is your responsibility to ensure that such information is accurate, complete and up-to-date. You have a right to access, modify, correct, or delete your personal information in your Account Profile created through the Mobile App. Note, however, that when you make use of the communication features of the Mobile App, such as a chat room or forum to share information with other Users, you generally cannot modify or remove such communications. Users who wish to delete or make any changes to any personally identifiable information provided to us, may do so by contacting us at [email protected]. Information will be updated as soon a possible. Note that any removed information may persist in backup copies for a reasonable period of time but will not be generally available to Users. We may reject requests that are unreasonably repetitive, require disproportionate technical effort (for example, fundamentally changing an existing practice), risk the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup tapes).

EMAIL LISTS

You may sign up for our email notifications or newsletters on our Website. In addition, when you register on the Mobile App, you will automatically receive special offer emails and notifications.

OPT OUT

You may opt out of receiving emails from us by following the opt-out link provided in any email received from us. You may opt-out of receiving other notifications from us by logging into your Account Profile on the Mobile App and changing your settings relating to such notifications.

CHILDREN

In compliance with the Children’s Online Privacy Protection Act, 15 U.S.C. §§ 6501-06 and 16 C.F.R. §§ 312.1-312.12, our Service does not permit children under 13 years of age to become Registered Users, and Golden 1 Center does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register. By using our site, you represent that you are not under 13 years of age.

 

THIRD PARTY WEBSITES, ADVERTISERS AND APPLICATIONS

Golden 1 Center may reference or include links to third party websites. Golden 1 Center is not responsible for the third party websites or for the privacy policies or information practices of third parties or their websites. You should review the privacy policies posted on such sites. Moreover, Golden 1 Center does not have access to or control of the cookies that may be placed by such third parties.

PROTECTING YOUR PERSONALLY IDENTIFIABLE INFORMATION

Because security is important to both you and us, we will always make reasonable efforts to ensure the security of our systems. Golden 1 Center employs physical, electronic and administrative safeguards to protect the information we receive from you from unauthorized disclosure. This includes our requirement for user names and passwords to access certain portions of the Services and our use of industry-standard SSL encryption to protect certain data transmissions. Registered Users should not share their user names or passwords with anyone. In addition, if you suspect unauthorized access to your information, it is your responsibility to contact Golden 1 Center immediately at [email protected]. Golden 1 Center personnel will never ask you to divulge your password in written or electronic communications. If at all, we will only ask you for your password when you contact us by phone and only in cases where you request customer service to correct a service problem that requires your password. Please be aware that Internet data transmission is not always secure and we cannot warrant that information you transmit utilizing this Site is secure.

BUSINESS TRANSFER

We may, in the future, sell or otherwise transfer some or all of its assets to a third party. Your personally identifiable information and/or technical information we obtain from you via this Site may be disclosed to any potential or actual third party purchasers of such assets and/or may be among those assets transferred.

USERS OUTSIDE THE UNITED STATES

When a User who is located outside the United States uses our Services, becomes a Registered User of our Services or elects to make certain information available to us or other Users, it is the User who is responsible for ensuring whether such actions and the sharing of information with us conforms to the User’s local data protection laws. Golden 1 Center is not responsible under such local data protection laws for information obtained through Services

NOTICE TO CALIFORNIA RESIDENTS - CALIFORNIA SHINE THE LIGHT LAW

California Civil Code Section 1798.83, known as the “Shine The Light” law, permits our Users who are California residents to request and obtain from us a list of what personal information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year and the names and addresses of those third parties. Requests may be made only once a year and are free of charge. Under Section 1798.83, we currently do not share any personal information with third parties for their direct marketing purposes.

EFFECTIVENESS

This Privacy Policy is effective as of July 1, 2016. We reserve the right, at any time, to modify, alter, or update this policy, and any such modifications, alterations, or updates will be effective upon posting. In the event we modify this Privacy Policy, your continued use of this Site will signify your acceptance of the modified Privacy Policy.
